A proposal in this regard was floated by BJP councillor Sarita Chaudhary and approved by the Standing Committee of the Municipal Corporation of Delhi.

The MCD will forward the resolution to the Delhi government for an approval.

According to the central government’s approval granted on Tuesday, subdivision is allowed only in 567 unauthorised regularised colonies, some special areas and urbanised villages.

“As sub-division is not currently allowed in posh colonies, a lot of illegal construction takes place there. We need to curb that. This can only be done if sub-division is allowed across the city in every colony. This will ensure that people will get their building plans sanctioned,” said Chaudhary.

If this proposed amendment is approved by the government, people will be able to build houses with layouts sanctioned by the MCD after due checks on structural safety and illegal construction.

Last month, a building collapse that killed 70 people at East Delhi's Lalita Park was an illegal structure built on a subdivided plot.

According to the MCD, most residents wishing to divide their properties and carry out different construction activities. The same, however, was not allowed as per the existing building by-laws.

Apart from not being able to get building plans passed for smaller plots, property owners in the capital were also not able to get plans passed for individual floors.

“Though the court permitted the MCD to sanction floor-wise plans, there are several practical problems in its implementation. One has to get a No-objection Certificate from all the floor owners,” said a senior MCD official.
