Prakash, the former military secretary, facing charges of being involved in a land scam in Sukna, West Bengal, had approached the tribunal to complain that he had not been given an opportunity to cross examine witnesses during a court martial, defence ministry officials said.
Meanwhile, Lt Gen Prakash's lawyer, Jyoti Singh has welcomed the ruling saying justice had been done at last.
Prakash was found guilty of using his position to influence the grant of a no-objection certificate by Rath, who was commander of 33 Corps in Sukhna, to the realtor.
