Woman to face trial for false rape case: HC

The Delhi High Court, on Monday, refused to quash a false criminal case of rape lodged by a Delhi Police woman employee against a man to ensure that she faces prosecution later for falsely implicating him.

The Delhi High Court, on Monday, refused to quash a false criminal case of rape lodged by a Delhi Police woman employee against a man to ensure that she faces prosecution later for falsely implicating him.

Justice Dhingra dismissed the petition despite plea from a Delhi-based property dealer that the woman has admitted to making false accusations against him early this year and they settled the matter out of court.

"I consider that an offence under Sec 376 of the IPC (for rape) being punishable with minimum sentence of seven years cannot be looked at so lightly," justice SN Dhingra said.

"The prosecutrix (the woman) cannot be allowed to turn around and say that she made a false statement and that now she has compromised the matter," he said, refusing to dissolve the FIR.

The court then left the matter for the trial court to acquit the man and initiate prosecution against the woman on charges of perjury.
