Sources said in 1978-79 the then ruling party had initiated a move to shift the Board of Revenue but it backfired in the face of stiff opposition by lawyers, politicians and litigants here.
"It is strange that the State Government is being ill advised again to shift Board of Revenue to Lucknow under the garb of Uttar Pradesh Revenue Code Bill 2006," said some lawyers while talking to the HT Live.
President of the Board of Revenue Bar Association HN Sharma said the State Cabinet had recently decided to shift the principal seat of the Board of Revenue.
But the same was not given consent by the Governor, who sent it back for reconsideration.
He said lawyers had also made representation to the Governor.
He said cases under the Land Revenue Act were being heard in Lucknow and the ones under the Zamindari Abolition Act were being heard here under an arrangement. But when there was a move to abolish the LR Act, lawyers in Lucknow went on strike. At that time we supported their cause. But the move to take away the principal seat from Allahabad would mean demeaning the old status of this city which will never be allowed under any circumstances.
Sources said, the Board of Revenue was established by the East India Company in 1975 at Fort William Calcutta for administration of justice.
Later, in the year 1831, the Board of Revenue, UP was established at Allahabad vide Bengal Regulation No 10 of 1831.
Following enactment of the law, Board of Revenue became subordinate to the High Court.
"Those at the helm of affairs have already meted out great injustice to us by stealthily shifting the library of the Board of revenue from here to Lucknow. The library contained some rare books which are no longer in print now," said some agitated lawyers.
"Funds could have been allocated for its maintenance, but instead of doing this they took away the entire library which was like a treasure for us," said a section of lawyers.
Besides, the lawyers practising in revenue side are also unhappy on some other counts too.
By UP Amendment Act 19 of 1997 second revision under Section 219 of UP Land Revenue Act was taken away. Similarly, by UP Amendment Act 20 of 1997 the second revision provided under Section 333 of UPZAR Act has also been taken away.
The Bar has already made representation against the above amendment. The matter is under consideration of the State Government, said president of the Bar HN Misra.
