Sanction for trial against Lalu illegal: Counsel

The case is related to the fraudulent withdrawal of over Rs 46 lakh from Banka, Bhagalpur treasuries of Bihar.

Arguing on the discharge petition before special CBI judge Munilal Paswan, the counsel of Railway Minister Lalu Prasad, on Wednesday said sanction for prosecution against Prasad was illegal in RC 63(A) of the multi crore fodder scam.

Prasad's counsel Chitranjan Prasad Sinha said the governor sanctioned the prosecution even without prior approval of the cabinet and the sanction order was signed by the deputy secretary of the governor and not by the governor.

The case is related to the fraudulent withdrawal of over Rs 46 lakh from Banka and Bhagalpur treasuries of Bihar in the animal husbandry department and was registered in 1996.
