Show-cause notice to 3 former CJMs

A DIVISION Bench of the high court comprising Justices O P Srivastava and Shailendra Saxena, here on Tuesday, issued notices to three former Chief Judicial Magistrates (CJMs), to show cause by December 5 as to why strict action be not taken against them for ignoring high court’s order.

Facts reveal that the high court in 2001, while admitting a State appeal for hearing, had allowed bail to the respondent accused, one Ravindra Tewari alias Guddu on furnishing a personal bond of Rs 15,000. The then CJM, Lucknow, Kalpana Mishra, however released the accused on furnishing a personal bond to the tune of Rs 10,000 only.

On coming to know the above facts, the high court took the matter seriously and asked the registrar general to inquire into the matter.

The inquiry report revealed that at the relevant time three Chief Judicial Magistrates viz. Kalpana Mishra, S K Pandey and M A Khan had held the office of the Chief Judicial Magistrate, Lucknow and each were found prima facie guilty of ignoring the high court’s order and not sending the report to the high court timely. The show cause notices were accordingly issued against all the three CJMs. The matter shall come up for hearing on December 5.
