The FIR said the accused tried to whip up communal passions by issuing CDs containing subversive contents.

Taking cognizance of reports in Hindi and English dailies and news channels about objectionable contents in a CD issued by the BJP for the election campaign, the district electoral officer ordered a probe into the matter.

Additional SP (East) Sadhna Goswami investigated the issue and handed over the report to the district magistrate. The report stated that the content in the CD was provocative enough to hurt religious sentiments. The distribution of CD during election would also create law and order problems and the act amounted to a criminal offence, the findings said.

Taking serious note of the report, the DM ordered registration of a case. Hazratganj station house officer Aadhesh Sharma lodged an FIR under sections 125, 153-A & B, 298-A, 505 and 295.

The investigating officer (IO) has yet to be deputed in the case.
