The Bandra metropolitan magistrate’s court had sentenced the actor to 15 days’ simple imprisonment on October 14, but he was later released on bail.

On October 29, John had filed an appeal in the sessions court against his conviction, stating that the ‘judge has misconstrued and has, without applying the principles relating to the acts of rashness and criminal negligence, convicted (Abraham)’.

The incident dates back to April 8, 2006, when Abraham had rammed his Suzuki Hayabusa bike into a bicycle with two youngsters on it at around 11.15 pm on Carter Road, Bandra.

After the accident Abraham had taken the victims – Shyam Kasbe, 22, and Tanmay Majhi, 19, both working at Judo Wine shop at Pali Naka – to the nearby Bhabha Hospital. Abraham was also injured, and so he later got himself admitted to Lilavati Hospital.

The case is now likely to come up for hearing on November 17.
