An obscenity case was filed against the actors and Rosa for the unbuttoning act during the Lakme Fashion Week in 2009.

Rosa withdrew the application after justice AR Joshi observed that prima facie there was a case against Rosa and he intended to dismiss the application.

“Probably you might have a very good case at the time of trial, but at this stage we don’t want to interfere,” said justice Joshi.

Rosa’s lawyer Aditya Khandeparkar said permission for the show was obtained on her behalf without her knowledge.

Rosa, who works as an assistant legal adviser with International Merchandising Corporation, the company thatco-promoted the event, had moved the high court in August 2010.
