‘State not bound to permit affiliation with SNDT varsity’

In a move that will affect colleges in Gujarat seeking affiliation to the city’s Shreemati Nathibai Damodar Thackersey (SNDT) Women’s University, the Gujarat high court recently upheld the government’s rejection of a No Objection Certificate (NOC) sought by colleges there, for starting colleges affiliated to the university.

In a move that will affect colleges in Gujarat seeking affiliation to the city’s Shreemati Nathibai Damodar Thackersey (SNDT) Women’s University, the Gujarat high court recently upheld the government’s rejection of a No Objection Certificate (NOC) sought by colleges there, for starting colleges affiliated to the university.

The court was hearing petitions filed in 2010 by charitable trusts, registered under the Bombay Public Trusts Act, running colleges in Gujarat. The petitioners had challenged the Gujarat government’s refusal to grant an NOC to the colleges for starting a self-financed college affiliated to the SNDT University.

According to section 105 (2) of the act, the university may allow colleges of other states to be affiliated to it, subject to the approval of the government of that state.

Concluding that it would not look into the validity of the section, the court held that the Gujarat government is not bound to grant the NOC to the colleges seeking affiliation with SNDT University.
