One arrested for 16-year-old’s rape in Jewar

Police said the accused plied the girl with beer and then raped her when she got drunk.

A 22-year-old man was arrested by the Jewar police on Monday for the alleged rape of a 16-year-old girl on August 24, regarding which a case was registered on August 29.

The police said the result of the medical test that had been ordered for the girl on August 29 was inconclusive on rape.

According to the police, the accused man, Rahul, is a distant relative of the girl, a resident of a village in Jewar.

“The girl knew the accused. She had gone with him willingly. However, what happened between the two was without the girl’s consent,” superintendent of police (rural), Vineet Jaiswal said. (A minor’s consent is not legally tenable).

The police further said on August 29, the girl’s family had filed an FIR alleging that their daughter had been kidnapped by two men on a motorcycle while she was on her way home from a stitching class.

They had alleged that she had been forced to drink liquor and then gang-raped.

However, after a thorough investigation, the police found the family’s version was flawed.

“The family filed the complaint after a delay of five days. Then we found that this wasn’t a gang-rape,” Jaiswal said.

“The family had alleged that the girl didn’t know the names of the accused who had allegedly abducted her, but, she recognised them as upper caste men from a neighbouring village. However, she was raped by a man, who also belongs to the scheduled caste,” Jaiswal added, referring to the fact that in addition to charges of rape and the POCSO Act, the unidentified accused had also been booked under the SC/ST Act in the initial FIR.

The police said accused admitted to the crime during questioning.

“According to his statement, he picked up the girl on a motorcycle around 5pm while she was on her way home from a stitching class. He took her to a neighbouring village in Khurja where he forced her to drink beer,” he said.

“After getting her drunk, he took her to a desolate forest area and raped her. Afterwards, he dropped her outside her home around 9 pm where she was found unconscious by her family members,” the SP said.

Jaiswal added that according to the accused’s statement, he acted alone.

The police said they were able to track the accused down through mobile surveillance, and arrested him on Monday morning from the Jehangirpur bus station.

A resident of Bulandshahr, the accused is unemployed and was in touch with the girl, as he frequently visited his aunt, a resident of the same village as the girl, according to the police.

The police have also recovered two empty cans of beer that were given to the girl, in addition to the motorcycle used by the accused.

The accused man was produced before a magistrate and later sent to jail.
