Jail supdt compulsorily retired for throwing party for rape accused RJD MLA Raj Ballabh

Throwing a lavish treat inside prison has cost a senior jail official his job.

In an unprecedented move, the Bihar government has decided to compulsorily retire the then jail superintendent of Biharsharif divisional jail, Moti Lal, for organising a special feast in the jail on the occasion of Holi — allegedly in honour of the rape accused and suspended RJD MLA from Nawada, Raj Ballabh Yadav, who was lodged there.

The feast was arranged on March 22 and 23 last year when Moti Lal, along with his three subordinates — the then assistant jail superintendent Ram Nandan Pandit and wardens Ram Lakhan and Ramesh Kumar — called special cooks of Yadav’s choice to cook mutton, puris and sweet dishes inside the jail.

The incident led to furore and chief minister Nitish Kumar asked IG (prisons) Anand Kishore to investigate the incident. The inquiry report indicted the three officials and they were subsequently dismissed on November 4, 2016, following an inquiry.

As for Moti Lal, a Bihar Prison Service (BPS) official, he was put under suspension on March 26, 2016, soon after the incident and departmental proceedings were initiated against him. The inquiry corroborated the charges, following which the official was served a showcause.

In his reply, Moti Lal admitted having organised the feast, but said the commodities and cooks were allowed inside “as per norms”.

However, his reply was not found satisfactory, and the incident was treated as a “security lapse”. “On important festivals like Holi, the sensitivity of prisons is higher and no stranger should be allowed inside without genuine reasons and nothing should be taken inside without proper entries in the jail register. It was gross dereliction of duty,” read the inquiry report, further indicting the official.

Home department official told HT on Tuesday that Moti Lal was accused of throwing a feast, which included preparation of special delicacies in huge quantity, in contravention of the jail manual. He was also charged with extending favours in addition to what was applicable as per laid down provisions to the high profile prisoner.

Meanwhile, Mridula Kumari, investigating officer of the rape case, sought bodyguards from Patna SSP Manu Maharaaj, citing threat to her life as the case trial had begun. Following her plea, two bodyguards have been provided to the IO.

WHAT THE DM’s SPOT REPORT SAID

Nalanda DM Thiyagarajan SM, in his probe report submitted soon after the incident, had found that all the four officials flouted jail manual rules to provide special privilege to the legislator. “The jail superintendent misguided the district administration and other senior authorities that chicken was served inside jail. Investigations revealed that mutton was cooked on two occasions. It was a feast given to other inmates by the four jail officials on behalf of the accused MLA. The cook from outside prepared the dishes against the jail manual and it was also not mentioned the jail register,” Thiyagarajan mentioned in the report.
