According to the UP RERA’s Conciliation Forum, most of the disputes were related to delay in execution of registered sale deeds, possession of houses, allotment of parking slots, shortcomings in maintenance and complaints of power back. The issues related to payment of interest on account of delay in possession of flats were also resolved.

“The UP RERA has been able to resolve more than 1150 disputes involving properties worth more than 345 crore through amicable settlement between homebuyers and developers,” said RD Paliwal, UP RERA, Conciliator.

Most of the disputes were from Gautam Buddha Nagar, Bulandshahr, Ghaziabad and Meerut, as per the UP RERA.

“The conciliation forum is the easiest way to resolve grievances of home buyers under which the resolution is sought to be arrived at by bringing the promoter and the consumer on one platform,” said Paliwal.

“After detailed discussions and negotiations between the parties in presence of representatives of both allottees and promoters, and moderation by the conciliator, dispute is resolved by consistent efforts,” added Paliwal.

“The entire model is turning to be a preferred time-saving disputes resolution process by both the parties. Both the parties honour agreements entered into by them in the conciliation forum and therefore allottees do not have to go through further proceedings for enforcement of the settlement,” he added.

Chairman, UP RERA, Rajive Kumar, stated that promoters and their allottees could utilise this forum for settlement of their disputes and save themselves from the agony of long, complicated and extensive legal proceedings.

Around 539 allottees of promoters like Gaursons Group, Supertech Group and Uppal Chaddha Group have resolved their disputes through this forum, Kumar added.

Last year, UP RERA had identified 76 pending projects and helped promoters complete them within a timeframe.
