MUMBAI: A metropolitan magistrate court on Tuesday issued a bailable warrant against actor Shilpa Shetty Kundra’s mother, Sunanda Shetty, after she failed to appear before the court in a cheating and breach of trust case filed against them.

The warrant was issued by Andheri metropolitan magistrate, R R Khan.
The case relates to a complaint filed by Parshad Firoze Amra, owner of an automobile agency who alleged that he had given a loan of ₹21 lakh to Corgifts, a Shetty family firm, but he was not paid after the demise of Shilpa’s father, Surendra Shetty.
Acting on Amra’s complaint of criminal breach of trust, cheating etc., the metropolitan magistrate court issued a process against Shilpa Shetty, her sister Shamita Shetty and their mother on February 11.
On Monday, a session court in the city stayed the process issued against Shilpa Shetty and her sister Shamita Shetty. However, it also said that the proceedings against their mother will continue in the lower court.
The sessions judge, while staying the process against the Shetty sisters, observed that their parents, Surendra and Sunanda, were partners in the firm, but the complainant have not filed any document to show that Shilpa and Shamita were also partners in the said firm.
“No doubt there are several factual and legal aspects involved which need judicial inquiry on merit. Hence the order passed by the trial court against applicant Shilpa Shetty Kundra and Shamita Shetty whereby process is issued is hereby stayed against them,” said the sessions court, adding that, the magistrate court can proceed against Sunanda.
On Tuesday, when the counsels for Sunanda filed an exemption application before the magistrate court, Andheri, it was opposed by the counsels Zain Shroff and Zubin Sheth of Y & A Legal who appeared for the complainant Parshad Firoze Amra. They later even filed an application for issuing a non-bailable warrant against Sunanda. Acting on their plea, the court issued a bailable warrant of ₹1000 against Sunanda, adjourning the case for report of bailable warrant on April 12.
