Man gets six-year jail term for killing taxi driver

A man, who killed his fellow taxi driver during a fight in 2003, has been awarded six years jail term by a Delhi court which held him guilty for culpable homicide not amounting to murder.

Convict Ram Sewak, was absolved of murder charge by Additional Sessions Judge JR Aryan who said there was no intention to kill the victim.

"It (murder) was committed without premeditation and in a sudden fight. It is difficult to draw that the accused caused death of the victim with an intention to commit murder," the court said.

It punished the convict under milder penal section 304 (culpable homicide not amounting to murder), instead of sentencing him under section 302 (murder) of the IPC, prescribing life term or death penalty.

The victim has been in jail for the last six years during trial.

The accused, hailed from Khagaria district of Bihar, and entered into a verbal duel with victim KB Rana on the intervening night of September 17-18,2003 in New Delhi.

The accused was unhappy with the victim as he had forced a passenger to hire his taxi. Later, when the fight turned ugly, he caught hold of the victim and banged his head several times on the road.

The victim later died at a hospital.The court, which relied on the testimony of a constable, an eye-witness, held that the accused did not intend to kill Rana.
