Original evidence of bribe missing

The original copy of a key document, which could be vital for to prove the payment of R200 crore as an alleged kickback to former telecom minister A Raja and his alleged associates in Kalaignar TV in lieu of irregular allocation of 2G spectrum and telecom licences, is yet to be recovered by CBI.

“The missing original document, which we are trying to recover, is an agreement dated December 12, 2008, purportedly executed between Cineyug Films Pvt Ltd (CFPL) and Kalaignar TV Pvt Ltd after which the payment of R200-crore kickback was made to Dynamic Balwas Realty...” an agency source said. Dynamix Realty Pvt Ltd (DRPL) had allegedly paid the alleged kickback worth R200 crore through its subsidiary companies — Kusegaon Fruits & Vegetables Pvt Ltd (KFVPL) and CFPL — to a Kalaignar TV bank account, said the source.

“The transfer of R200 crore was a quid pro quo for the grant of UAS licences to Swan Telecom pvt ltd,” said the source. The CBI has informed the trial court about the missing document, but the source said the agency had a copy of it.

Two scam accused arrested by the CBI, Asif Balwa (a cousin of Swan Telecom’s former MD Shahid Balwa) and Rajiv Aggarwal (associated with KFVPL) were allegedly “instrumental in transferring the sum of R200 crore” but the duo’s “replies were evasive”.
