Houses for poor in Gurugram’s DLF phases 3 and 5 in violation of rules

The enforcement wing of department of town and country planning has asked the concerned authority to disconnect electricity supply to the EWS houses till such time the owners restore these buildings to the original sanctioned plan.

The enforcement wing of department of town and country planning (DTCP) on Saturday recommended the cancellation of occupation certificates (OCs) granted to 157 economically weaker section (EWS) houses in DLF phases 3 and 5 for construction of illegal floors and rampant building plan violations.

The department has also directed the developer to disconnect water supply and sewage connections to these houses. Apart from that, the authority has asked state-run discom Dakshin Haryana Bijli Vitran Nigam to disconnect electricity supply to these houses till such time the owners restore these buildings to the original sanctioned plan, officials said.

Further, after restoring their buildings to the original plans, the offenders need to apply for fresh occupation certificate of their building, the DTCP said.

“We have recommended the revocation of OCs granted to 70 plots in DLF phase 3 and 87 plots in DLF 5 to district town planning, Gurugram for further action. Most of the house owners have illegally constructed additional floors and have not left space on the front and rear sides as is mandatory for EWS plots of 60 square yards,” Ved Prakash Sehrawat, district town planner (enforcement), said.

Sehrawat further said that owners had been asked to take corrective measures, failing which water and sewer connections to these plots will be disconnected. “These EWS houses have been built in violation of the sanctioned plans and they pose a risk to the safety and security of not only the occupants but also people living nearby. They will have to follow the rules and stop using their properties for commercial activities,” he added.

To ensure that the directions are enforced in letter and spirit, the department will also take up the matter with deputy commissioner, Gurugram for not executing and sale deed or lease deed in these plots till they are restored in conformity with the original building plans, officials said.

The action by the department comes after several complaints were lodged by residents, including against the developer, regarding illegal constructions on the EWS plots meant for buyers from economically weaker section. In their letter, the enforcement authorities have stated, “Various EWS plot owners have raised unauthorised construction beyond the permissible limits/zoning limits in their respective properties, and, in fact, some properties are being used for commercial use. The matter was also discussed in the district TASK Force meeting held on August 1 under the chairmanship of the district magistrate, Gurugram, wherein it was decided that since the unauthorised construction in EWS plots of licensed colonies has been done a large scale, therefore electricity and water connection of such offenders may be disconnected to discourage the misuse of EWS plots and the non-conforming activity being done in such properties (sic).”

DTCP officials said that a survey is being conducted by its teams led by ATP Narender Kumar and Amit Madholia to identify the EWS plots and violators in private colonies across Gurugram. “This action is being taken in phases and earlier EWS houses violation the plan were sealed in Sun City township,” said Madholia.
