Two more juveniles were apprehended on Tuesday in connection with the gang rape of a minor girl in Hyderabad on May 28, police said.

The police had earlier revealed the name of the fifth absconding accused assuming he was not a minor, but he is still three months short of turning 18, Anand said. (Representational photo)

“The case has come to a logical end with the arrest of all six persons,” said Hyderabad police commissioner CV Anand at a press conference late on Tuesday evening. Of the total six accused in the case, five are juveniles while the sixth one, 18-year-old Saduddin Malik, is lodged in judicial custody, he added.

“While only five accused including Malik were involved in the gang rape, the fifth juvenile who was arrested on Tuesday… got down from the car much before the incident took place,” Anand said.

Though the names of the five juveniles were not disclosed, a senior police official on the condition of anonymity said the fifth juvenile, who was arrested on Tuesday, is son of a legislator belonging to the All India Majlis-e-Ittehadul Muslimeen (AIMIM).

“We have booked the five accused for rape under Sections 376-D (gang rape), 323 (causing injuries) and 376 (kidnapping) of the Indian Penal Code, besides the POCSO Act,” Anand said.

No rape case was lodged against the fifth juvenile, however, after going through the CCTV footage and some videos circulated on social media, a case under IPC Sections 354 (outraging the modesty) and 323 (causing injuries), besides relevant sections of the POCSO Act was registered against him, the top cop said.

The police had earlier revealed the name of the fifth absconding accused assuming he was not a minor, but he is still three months short of turning 18, Anand said.

Meanwhile, another case has been registered under the Information Technology (IT) Act for circulating pictures and video of the victim while she was going in the car, the top cop said, adding that the accused will have to bear the medical expenses of the survivor and the cost of her rehabilitation.

“These sections under which the cases have been booked are very stringent, so much that the accused are liable for imprisonment for not less than 20 years or life. A special court will be set up to try the case and award the punishment,” he said.

Giving details about the crime, the commissioner said the party at Amnesia and Insomnia pub was planned by a minor boy from Bengaluru on March 20. “He consulted his three friends in Hyderabad, who booked the pub for about 150 people in April. The minor had posted the details of the non-alcoholic, non-smoking party on his Instagram account,” the commissioner said.

The party was fixed between 1.30 pm and 6 pm on May 28.

“The CCTV footage obtained from the pub revealed that the accused had conspired to rape the girl in the pub itself,” Anand said.

The girl told the police that a couple of the accused had misbehaved with her and another girl in the pub, but they managed to avoid them.

“As the party was coming to an end, the girls came out and the accused followed them. While one girl left in a cab, the accused trapped the victim girl and took her in a Mercedes Benz car. At a pastry shop, she was shifted to Toyota Innova, in which she was raped,” the commissioner said.

On June 3, the police arrested 18-year-old Malik, in the next two days, three juveniles were apprehended. While Malik was remanded to judicial custody, the juveniles were sent to the custody of the juvenile court. “On Tuesday, we have arrested the fourth juvenile accused in the rape, along with the fifth juvenile. We shall send them to the custody of juvenile court,” he added.
