Class 12 student gets 2 marks relief from MP High Court

In an important decision, the MP high court has directed the MP Board of Secondary Education to issue a fresh mark-sheet to a petitioner student by adding two more marks in General English subject.

In an important decision, the MP high court has directed the MP Board of Secondary Education to issue a fresh mark-sheet to a petitioner student by adding two more marks in General English subject.

Harish Mishra of district Sidhi scored 70 marks out of 100 in General English in class 12 board examination. He was aggrieved as he felt he was not awarded marks for two questions of one mark each which he had answered correctly.

The petitioner procured a copy of his answer-sheet and model answers of General English subject from the Board of Secondary Education MP under Right to Information Act. On going through the copy of his answer-sheet and the model answers, the petitioner found he had given correct answers for two questions but no marks were awarded. Besides the petitioner said he was allotted less marks in three questions of descriptive nature. The petitioner moved HC as there is no provision to revaluate answer sheets in class 12 board examination.

The single judge bench on July 15, 2014 dismissed the petition considering absence of any statutory provisions for revaluation of answer-sheet. Later an appeal was filed challenging the single judge bench order.
