60-year-old Ghaziabad man’s 30 year wait to get possession of flat from GDA

Raj Prakash Tyagi, a Ghaziabad resident, who is 60-year-old now, was allotted a house by the GDA under the economically weaker section (EWS) in 1989.

Thirty years ago, Raj Prakash Tyagi was allotted a flat in Govindpuram by the Ghaziabad Development Authority (GDA). However, he is yet to get the possession of his house.

Tyagi, a Ghaziabad resident who is 60-year-old now and is “paralysed”, was allotted the house for the economically weaker section (EWS) in 1989. Now, he has moved the Uttar Pradesh Real Estate Regulatory Authority (UP-Rera) to get the possession of his flat. On Thursday, UP-Rera’s bench 1 in Greater Noida heard his case, and directed the GDA to file its reply by the first week of June, 2019.

The allottee’s advocate, Vishal Rana, said,“My client Raj Prakash Tyagi had applied for EWS house under Govindpuram housing scheme in 1989. The cost of house was Rs 32,000 for ground floor and Rs 30,000 for the first floor house. He had paid registration amount of Rs 3,200. On November 11,1989, a draw was held and he was declared successful for allotment of a flat. On December 31,1990, he had paid two instalments as per the allotment letter.”

According to Rana, on June 5,1994, GDA had sent a letter informing him that his EWS house at Govindpuram scheme has been transferred to Indirapuram scheme and the deposited amount has been adjusted in the new allotment. Further, Tyagi was informed that the payment details would be communicated later, and other terms and conditions remained the same, the lawyer said.

Later, Tyagi could not pay the instalments in time as he was not communicated about the payment schedule in spite of his visit to the GDA office asking for it, Rana said.

On March 17, 2011, Tyagi asked GDA for the registry of flat and due amount for payment. On February 11, 2012, he got a letter from GDA informing that as on February 29, 2012 total due amount of that flat was Rs 2.09 lakh, Rana said. Tyagi was asked to avail the one-time settlement scheme and pay the amount by March 31, 2012. On March 28, 2012, he paid Rs 1.87 lakh as directed by GDA officials, the advocate said.

“He has now filed a complaint in UP-Rera demanding possession of the house. Presently, he is over 60 years old and has been paralysed and is unable to move,”said the advocate.

When asked, UP-Rera chairman Rajive Kumar said,“GDA representative has sought time to file reply as the case is very old.”
