The SC direction for an affidavit on behalf of the Prime Minister explaining the inaction on a plea asking him to sanction prosecution of A Raja comes three months after the Centre had explained the “delay and silence” to the Delhi High Court.

A convinced court had on August 18 dismissed Subramanian Swamy’s petition then. SG Gopal Subramanium who represented the PM in the High Court too had submitted that in response to Subramanian Swamy’s letter October 31, 2009, March 8, 2010 and 13, 2010, he had been informed that the CBI has registered a case on October 21, 2009 against officers of DOT, persons/companies and others and probe was on.

The SG told the court that in such a situation it was impermissible to take a decision on Swamy’s application because that may ultimately affect the investigation.

A bench of chief justice Dipak Misra and justice Manmohan had said it would be inappropriate to the Centre to take a decision. Its judgment is posted on the website of the Delhi High Court.
