HC refuses to quash FIR in gangrape case

Refusing to quash the FIRs against the accused in the Delhi gang rape case, the Delhi High Court on Monday asked a lawyer for two of them to prove his claim that they were innocent by grilling the prosecution witnesses in the trial court and not by filing applications in the higher court. "If you are sure they have been falsely implicated, rather than filing such applications, you grill the police witnesses and other prosecution witnesses in the trial court and prove their innocence. No one has stopped you from doing that," Justice Mukta Gupta told Manohar Lal Sharma, the counsel for accused Mukesh and Akshay.

The judge, however, agreed to hear arguments on the petition on April 17 and allowed Sharma to place on record the copies of the trial court's order on framing charges against the five accused.

New Delhi: The special judge conducting the Delhi gang rape trial will examine the CCTV footage from Tihar jail after one of the accused last week appeared in court with a fractured arm and alleged thrashing at the hands of fellow inmates.

Accused Vinay Sharma and Akshay had filed an application seeking transfer to Rohini jail from Tihar jail, as they feared for their lives in the jail. The Tihar jail authorities in its reply said that Vinay could be shifted to Rohini jail as he is an adolescent. Last month, Ram Singh, prime accused in the case had committed suicide in the jail.
