SC directs Rajasthan Police to arrest BB Mohanty

SC directed the Rajasthan Police not to arrest for six weeks Senior Orissa IPS officer B B Mohanty, reports Satya Prakash.

The Supreme Court on Monday directed the Rajasthan Police not to arrest for six weeks Senior Orissa IPS officer B B Mohanty, charged with helping his rape convict son Bitihotra Mohanty escape while on parole. Bitihotra was convicted of raping a German girl.

A Bench headed by Justice C K Thakker, however issued notice to the IPS officer on a petition filed by the Rajasthan Government questioned the authority of the Orissa High Court in entertaining his petition seeking quashing of the proceedings against him. The Rajasthan Government wondered how the Orissa High Court grant grant anticipatory bail to Mohanthy senior. His anticipatory bail was due to expire on April 12.

B B Mohanty, presently working as the DGP, Home Guards, Orissa, stood surety for his son Bitihotra's surrender but failed to ensure his presence when required. The Rajasthan police accused him of complicity in his son's escape and registered a FIR seeking to arrest him.

However, the Orissa High Court on March 1, granted anticipatory bail to the IPS officer, following which the Rajastan Government filed an appeal before the apex court.
