Two convicted for sexually abusing their 12-year-old relative in Mumbai

One of the accused sexually abused her on the pretext of marriage, and impregnated her, while the other would threaten to kill her parents.

A special court for the Protection of Children from Sexual Offences Act (POCSO) on Friday convicted two men for sexually abusing their minor distant relative in 2015. One of the accused sexually abused her on the pretext of marriage, and impregnated her, while the other would threaten her to kill her parents.

The court has sentenced Govind (name changed), who impregnated the girl, to rigorous imprisonment for 20 years with a fine of Rs50,000. The other convict, Pramod (name changed), has been sentenced to rigorous imprisonment of 10 years with a fine of Rs50,000. The court has further directed that Rs80,000 from the fine amount be given to the girl as compensation.

Govind, was staying at the girl’s house between September 2014 and April 2015. He had come from Uttar Pradesh to work with victim’s father.

As per the prosecution’s case, one day when Govind went home for lunch, he found the girl alone in house. He then sexually abused the girl, who was just 12 years old at that time.

Girl’s father in his deposition claimed that the accused would sexually abuse his daughter when his wife would go to drop their son to school and the two were alone in the house.

According to the prosecution, the accused took the girl to UP between April 18, 2015 and April 30, 2015 on the pretext of marriage.

However, the girl later told her parents that during their stay in UP, another distant relative of the family, Pramod, took her to terrace and raped her. He then threatened her to not complain to anyone or he would kill her family.

Later, when they returned to Mumbai in July, the girl started experiencing acute abdomen pain. When her parents took her to the hospital, they found out she was pregnant. The father claimed that by the time they came to know of the pregnancy she was in her 26th week.

The girl later delivered a baby boy in Sion hospital.

The court considered medical evidence, and the testimony of the father to convict the accused.
