SC to hear Chandrababu's plea on Nov 23

A three-judge bench of justices Altamas Kabir, TS Thakur and Dipak Mishra would take up the matter during the mentioning time.

The high court had earlier directed a CBI probe on a petition filed by YS Vijayamma, widow of late chief minister YS Rajashekar Reddy.

Telugu Desam Party (TDP) leader CM Ramesh, who filed the petition, said the direction raised important questions of law, namely "whether the high court is justified in directing an investigation into the allegations without any notice to Naidu and the party.

It was submitted that Vijayamma's petition was politically motivated and gross abuse of the process of the court.

He said the directions of the high court were erroneous, unsustainable and quite contrary to the principles of natural justice.

He quoted the Supreme Court judgement in the case of ‘Divine Retreat Centre Vs State of Kerala', wherein it was said that "no judicial order can ever be passed by any court without providing a reasonable opportunity of being heard to the person likely to be affected by such an order and particularly when such order results in drastic consequences of affecting one's own reputation."
