Supreme Court rejects dismissed BSF jawan’s petition challenging PM Modi’s election from Varanasi
A three-judge bench comprising CJI SA Bobde and Justices AS Bopanna and V Ramasubramanian noted that Tej Bahadur Yadav’s petition challenging PM’s election was rightly dismissed by the Allahabad High Court.
The Supreme Court on Tuesday dismissed a petition filed by sacked Border Security Force (BSF) constable Tej Bahadur Yadav challenging the election of Prime Minister Narendra Modi from the Varanasi parliamentary seat in last year’s Lok Sabha elections.
In delivering the verdict, a three-judge bench comprising chief justice SA Bobde and Justices AS Bopanna and V Ramasubramanian dismissed Yadav’s challenge to the Allahabad High Court’s verdict in this regard.
Yadav had been given a ticket by the Samajwadi Party (SP) to contest from the Varanasi constituency. However, the Returning Officer (RO) rejected his nomination on grounds that he did not produce certificate from the EC certifying that his dismissal was not on grounds of disloyalty or corruption. Yadav was sacked from the BSF in 2017 after a video went viral of him complaining about the quality of food served to jawans.
His earlier petitions against rejection of his nomination papers have already been rejected.
The Supreme Court had on November 18 reserved its verdict over Yadav’s plea challenging PM Modi’s election.
