Patna HC sets aside acquittal of Surajbhan in a murder case

The Patna high court on Tuesday set aside the acquittal of the LJP strongman Surajbhan and three others in a murder case.

The Patna high court on Tuesday set aside the acquittal of the LJP strongman Surajbhan and three others in a murder case.

A division bench comprising Justice VN Sinha and Justice AK Lal set aside the acquittal of Surajbhan and three others by the Barh sub-division court last year in the murder case of one Umesh Yadav and asked the lower court to start de novo trial (new trial) by a different tribunal.

A Barh sub-division court had, vide its order dated July 24, 2012, acquitted the LJP strongman and three others in the murder case for want of evidence against them.

The victim's brother Shankar Yadav had challenged the acquittal of Surajbhan and others in the Patna high court.

Yadav, the former Zila Parishad member, was shot dead by unidentified persons in Mokama in 2003.
