The Delhi High Court has sought an explanation from the Delhi Police Commissioner for not prosecuting three police officials who had got a businessman and his father convicted in a criminal case six years ago, using false evidence.

The court took a serious view of the matter as Delhi Lt. Governor Tejendra Khanna had sanctioned their prosecution in January this year.

Thirty-five-year old Manjeet Singh Chugh, Joint Secretary of South Extension Part-I RWA and his father Mohinder Chugh had been acquitted by the High Court in 2008 after police confessed they had been framed.

“It is established the case is the outcome of rivalry between the police officials and the appellants,” the High Court had said. The duo paid the price for taking on some policemen in the Kotla Mubarakpur police station, who accepted bribe from street vendors.

An attempt at culpable homicide charge was slapped on them.

On a complaint by Chugh, Justice S N Dhingra on Friday asked Commissioner Y S Dadwal to respond by June 21 why no action has been taken against Inspector Ashok Kumar, SI Sandeep Sharma and SI Sunil Jain.

Fed up of corrupt policemen in South Ex market, Chugh had petitioned the then police commissioner against several policemen, including SHO Kumar and Sharma.

The local police soon got a chance to get even with him when he and his father nabbed a thief inside their shop.

In his attempt to escape, the thief Anirodh fell down and sustained injuries on his head. Though Anirodh was arrested, SI Sharma, who was “deliberately” made the Investigating Officer by the SHO, asked the thief to lodge a counter case, saying that he suffered the injury after Chugh hit him with an iron rod.

After an enquiry on Chugh’s plea, Defence Colony ACP and ACP (Vigilance) A S Grover, in separate probes, concluded that the case was false, after which. police decided to withdraw the case. But Chugh and his father had already been convicted.

However, Chugh took the battle to the High Court.
