Clarify MLNMC status: HC to V-C

The Allahabad High Court has opined that the vice-chancellor of the Allahabad University should call a meeting or a special meeting of the AU executive council at the earliest, preferably within a period of one month, so that a decision can be taken regarding the status of Moti Lal Nehru Medical College, Allahabad and associated hospitals. The court observed, ?We see no reasons as to why the benefit of Central funding be denied to the otherwise financially starved Moti Lal Nehru Medical College and its associated hospitals.

The Allahabad High Court has opined that the vice-chancellor of the Allahabad University should call a meeting or a special meeting of the AU executive council at the earliest, preferably within a period of one month, so that a decision can be taken regarding the status of Moti Lal Nehru Medical College, Allahabad and associated hospitals.

The court observed, “We see no reasons as to why the benefit of Central funding be denied to the otherwise financially starved Moti Lal Nehru Medical College and its associated hospitals. It is, therefore, imperative that the Executive Council of AU should meet at the earliest to take a decision on the matter”.

To recall, the AU has been converted into a Central university. Though Moti Lal Nehru Medical College was a constituent college of AU, its fate still hangs in balance- whether it should go with the State Government or the Central Government.

Making these observations, a Division Bench comprising Justice Sunil Ambwani and Justice Dilip Gupta said that the decision so taken by the Executive Council shall be placed before the court.

The court said, “A persual of the letter dated January 23, 2006 sent by the Deputy Secretary, Government of India, Ministry of Human Resource Development regarding the status of Moti Lal Nehru Medical College clearly indicated that the HRD had already decided to bring the AU alongwith its constituent units within the Central Government funding and that even before conversion of AU into a Central university, the Moti Lal Nehru Medical College was a constituent college of the AU. It is, therefore, for the AU to decide whether it wanted to maintain the MLN Medical College and SRN or to admit it to its privileges as a university college and in case the university decides to maintain the aforesaid as a university college, it would be funded by the ministry through the UGC.”
