Cops in dock for diluting rape case to molestation

A city court judge has asked the commissioner of Delhi police to initiate action against police officials, who colluded with government hospital doctors to convert a rape case into that of molestation. HT reports

A city court judge has asked the commissioner of Delhi police to initiate action against police officials, who colluded with government hospital doctors to convert a rape case into that of molestation.

Additional Sessions Judge Gurdeep Singh sentenced a 25year old man, Mumtaz, from Yamuna Vihar to 10 years imprisonment. He also slammed the area station house officer and the investigation officer.

The judge noted that after the incident on September 7, 2009, the child, accompanied by her mother and investigating officer Yamuna Prasad, was taken to GTB Hospital in East Delhi. The judge said a male doctor instead of a female doctor from gynaecological side examined the child. “On account of shame, the victim did not disclose her sexual assault to the male doctor,” said the court.

The case was registered at Seelampur police station as a case of molestation. The defence argued that the accused was being fabricated in the case, as the doctor has not given any opinion of child going through sexual intercourse. “Investigating officer despite knowing the facts and having seen the assault on the private part of the child had chose to scale down the offence," said the judge.

The judge examined the child in presence of her mother and an advocate from Delhi Commission for women in chamber. “The child correctly identified the accused. She narrated the entire sequence of events which took place on the day of the incident,” said the judge. He also examined child's mother statement and both were consistent.

The court also issued directions to the medical superintendent of GTB hospital to ensure that women patients, particularly children, brought for medical check up be examined by a woman doctor.
